Anticipated Disbursements on Leasehold Purchases (in addition to the search fees and Land Registry fees above):

  • Notice of Transfer fee – This fee, if chargeable, is set out in the Lease. Often the fee is between £50.00-£100.00
  • Notice of Charge fee – (if the property is to be mortgaged) – this fee is set out in the Lease. Often the fee is between £50.00-£100.00.
  • Deed of Covenant fee – This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £200.00-£300.00.
  • Certificate of Compliance fee – To be confirmed upon receipt of the Lease, this can range between £100.00-£200.00

These fees vary from property to property and can, on occasion, be significantly more than the ranges given above. We can give you an accurate figure once we have sight of your specific documents.

You should also be aware that ground rent and service charge are likely to apply throughout your ownership of the property. We will confirm the ground rent and the anticipated service charge as soon as we receive this information.

Stamp Duty Land Tax – this is set out above and again, is the same as a freehold purchase.

There are sometimes matters which arise during the course of a purchase/sale that may cause an extra charge to be levied. Please see the table below for a list of the instances which may arise:

Tariff of Additional Charges

This Tariff and guide has been prepared to explain the additional services that may fall outside work associated with a residential property sale or purchase.

While post additional services are not generally needed for a standard sale or purchase. If extra work is needed then it will be charged for in accordance with the following details:-

Defective Title (including flying freehold)

If in the course of selling or buying your property a defect is identified then a fee will be charged for the additional work in rectifying this. A quotation can be given once the nature of the defect has been established.

Defective Title Insurance Policy

If a title defect has been identified and an insurance policy is taken out to protect against future liability then the fee for the legal work involved will be £40.00 plus VAT

Statutory Declaration

If during the sale or purchase it is necessary for us to prepare a statutory declaration then the fee for the legal work in preparing a document will be £100.00 plus VAT

Handling or Registering a Restriction or Caution

If there is a title restriction registered or to be registered against your property or against the property you are buying the fee for the legal work in complying with it will be £65.00 plus VAT

Deed of Covenant

If a deed of Covenant is required when you sell or buy your property the fee for the legal work for preparing it will be £100.00 plus VAT.

Third Party Solicitors/Managing Agents

If during the transaction we need to deal with another firm of Solicitors, the fee for the legal work involved in those dealings will be £100.00 plus VAT

Deed of Grant

When a property lacks rights for proper use and enjoyment (eg any access) and it is necessary for a deed to be prepared to correct this, a quotation can be given once the nature of the additional documentation has been established.

Multiple Titles

If the property you are selling or buying has more than one registered or unregistered titles the fee for the additional legal work in dealing with those titles will be £75.00 plus VAT.

Multiple Sellers

If there is more than one Seller we have to deal with at different addresses then there will be an additional charge of £75.00 per person plus VAT.

Multiple Sale Contracts

If you sell your property and instruct us to send out more than one set of contracts to prospective buyers a quotation can be given once the nature of the extra work has been established.

Redemption of Mortgages

If there is a mortgage on a property for you are selling there will be a mortgage discharge fee of £20.83 plus VAT payable

If you have more than one loan on the property you are selling we will be required to clear the additional loan on completion and the fee for the additional legal work involved in dealing with each additional loan on completion will be £75.00 plus VAT

Declaration of Trust

If you ask us to prepare a Declaration of Trust to record unequal contributions made in the purchase of your property then the fee for the additional legal work will be £250.00 plus VAT

Unregistered Titles

If the property you are buying or selling has not been registered with the Land Registry, the fee for additional legal work undertaken with the unregistered title will be £75.00 plus VAT.

Completion

Most Lenders require us to give them a minimum of 5 working days’ notice when requesting the transfer of mortgage funds. The request is normally given after contracts have been exchanged. Consequently, if there is less than 5 working days between exchange and completion we reserve the right to charge a fee for the additional legal work involved in completing the transaction at short notice which will be £75.00 plus VAT.

Deed of Postponement

If in the course of a purchase or re-mortgage transaction it becomes necessary to prepare a deed of Postponement or Deed of Priority, then the fee for the legal work involved will be £75.00 plus VAT.

Retrospective Consent

If in the course of selling or re-mortgaging your property it becomes necessary to obtain retrospective consent for e.g. extensions or alterations (under an earlier covenant) then the fee for the legal work involved in obtaining retrospective consent will be £75.00 plus VAT.

How long will my house sale/purchase take?

How long it will take from your offer being accepted until you can move will depend on a number of factors. The average process takes between 12-16 weeks.

It can be quicker or slower, depending on the parties in the chain. For example, if you are a first time buyer, purchasing a new build property with a mortgage in principle, it could take 3 weeks. However, if you are buying a leasehold property that requires an extension of the lease, this can take significantly longer, between 4 and 6 months. In such a situation additional charges would apply.

Stages of the process

The precise stages involved in the purchase of a residential property vary according to the circumstances. However, below we have suggested some key stages that you may wish to include:

  • Take your instructions and give you initial advice
  • Check finances are in place to fund purchase and contact lender's solicitors if needed
  • Receive and advise on contract documents
  • Carry out searches
  • Obtain further planning documentation if required
  • Make any necessary enquiries of seller's solicitor
  • Give you advice on all documents and information received
  • Go through conditions of mortgage offer with you
  • Send final contract to you for signature
  • Agree completion date (date from which you own the property)
  • Exchange contracts and notify you that this has happened
  • Arrange for all monies needed to be received from lender and you
  • Complete purchase
  • Deal with payment of Stamp Duty/Land Tax
  • Deal with application for registration at Land Registry

Estate Administration

The exact cost for administering a deceased person's estate will depend entirely on the individual circumstances of the matter and the amount of work we are required to undertake on your behalf.

For example, costs will be lower if there is a valid Will, no more than one property, no more than two bank or building society accounts, one or two beneficiaries, no disputes between beneficiaries, no claims against the estate, no Inheritance Tax payable and the executors do not need to submit a full account of the estate to H.M. Revenue & Customs.

Costs are likely to be higher if there is no Will, if the estate holds any stocks and shares, if there are any foreign assets, or if Inheritance Tax is payable.

Please note the following regarding all fixed costs stated below:

  • All prices are starting from. Once we have met with you and have taken full instructions, our costs for dealing with your matter may be more than that stated below if additional work is required or if the matter is more complex than usual. For example, if a letter of wishes needs to be prepared, in addition to your Will, then additional charges may apply.
  • All prices are exclusive of VAT. VAT will be added at the current rate (presently 20%)
  • If we are required to meet with you away from the office (for example, at your own home), then additional charges may be made.
  • Travelling expenses are charged at 45p per mile plus VAT (total 54p per mile).
  • *The fixed fee for grant only applications: this is only for estates that are not taxable; where an IHT205 form (only) is required to be completed and where all necessary information (and evidence thereof) relating to the assets and liabilities of the estate has been ascertained by you. All other cases will be dealt with in accordance with our hourly rate (see our administration of estate client care/costs letter)

Driving offence, guilty plea – fixed fee £350.00 plus VAT

Fee includes:

  • 2 hours attendance/preparation:
    • considering evidence
    • taking your instructions
    • providing advice on likely sentence
  • Attendance and representation at a single hearing at the Magistrates Court

The fee does not include:

  • instruction of any expert witnesses
  • taking statements from any witnesses
  • advice and assistance in relation to a special reasons hearing
  • advice or assistance in relation to any appeal

The key stages of your matter are based on the presumption that you are entering a guilty plea and have a date for your hearing.

  • Meet with your solicitor to provide instructions on what happened.
  • We will consider initial disclosure, and any other evidence and provide advice.
  • Arranging to take any witness statements if necessary (this will have an additional cost, of £100.00 per witness)
  • We will explain the court procedure to you so you know what to expect on the day of your hearing, and the sentencing options available to the court.
  • We will conduct any further preparatory work, obtain further instructions from you if necessary and answer any follow up queries you have.
  • We cannot provide a timescale of when your hearing will take place, as this depends on the court listing for that day.
  • We will attend court on the day and meet with you before going before the court. We anticipate being at court for no more than half a day.
  • We will discuss the outcome with you. If advice is required on appeal, this will carry an additional cost.

Business to business debt that is undisputed – fixed fee £150.00 plus VAT

These costs apply where your claim is in relation to a debt which is not disputed and enforcement action is not needed. If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about costs if necessary, which could be on a fixed fee (e.g. if a one off letter is required), or an hourly rate if more extensive work is needed.

Anyone wishing to proceed with a claim should note that:

  • The costs quoted above are not for matters where Court action, is needed to collect your debt.
  • We will discuss further fees with you if Court action is required.

Our fee includes:

  • Taking your instructions and reviewing documentation
  • Undertaking appropriate searches
  • Sending a letter before action
  • Receiving payment and sending onto you
  • If payment is not received within 28 days, providing you with advice on next steps and likely costs

Matters usually take 2-4 weeks from receipt of instructions from you to receipt of payment from the other side, depending on whether or not it is necessary to issue a claim. This is on the basis that the other side pays promptly on receipt of letter before action. If Court action is needed, the matter will take longer to resolve.
